Why do consumers like CAFE? Well, the short answer is that a gas tax (which is infinitely superior from a pure policy perspective) hits them directly in the pocketbook, while CAFE forces automakers to absorb the cost increases before passing them along to consumers in the form of higher MSRPs. But underlying this fact is a larger issue that’s driving support of increased emissions regulation: gas is getting more expensive. As I pointed out in my recent editorial on the subject, for all the automakers’ whining about CAFE increases, it seems that energy prices are moving the market in the same direction anyway (the average family will spend $3,100 on gasoline this year).

According to a Consumer Federation of America study [PDF], the steadily-rising price of energy has consumer’s even more concerned about gas prices and dependence on the volatile Middle East than they were during the height of the last fuel price shock in the Summer of 2008. As a result, support for a 60 MPG fuel economy standard doesn’t go below 49% (among Independents) even assuming a ten-year payback period, and earns the support of 63% of Democrats. Most Americans depend heavily on their license to drive – for their jobs, their family obligations and their recreational travel.

Naturally, some of our driving needs take us out of state. And as is well-known, traffic enforcement tends to focus on out-of-state drivers – maybe because it is that much harder for drivers to successfully contest out-of-state tickets…?

Compounding this problem is the fact that out-of-state violations almost inevitably impact the home-state driver’s license, sometimes even resulting in suspensions. And if out-of-state tickets are hard to contest, then clearing up interstate licensing actions can be nearly impossible.

In the nanny state’s never-ending battle to completely eliminate all driving risk, and its corresponding effort to make sure that every bit of your traffic record is available to every enforcement agency in the land, several compacts have been set up between the states for the sharing of motorists’ driving offense information.

This might be a good thing, if all transportation departments had fair, clear, and consistent rules and procedures for how out-of-state violations should impact home-state license privileges – and those agencies took responsibility for treating motorists fairly when problems arise.

The reality, though, is that such situations lead to vicious circles where neither the bureaucracy of the ticketing state nor the home state is willing to step up and unilaterally correct problems. Read More >

Today’s sign of the times comes courtesy of the world of social media, and calls into question some of our most basic assumptions about the world of cars. France, it seems, experienced a 12.8% increase in on-road fatalities in the first quarter of this year, and the New York Times reports that the French government is responding by banning devices that scan the road ahead for speed camera radar waves.

A decade ago, the death rate on French roads was among the worst in Europe, and the government reacted in 2002 with what some drivers called repressive tactics. Radar cameras were erected at intersections throughout the country, which captured a motorist’s license plate if the car surpassed the speed limit by more than 5 kilometers an hour (3 m.p.h.), deducted points off a motorist’s license and sent a fine through the mail.

The measures were deemed successful. The International Transport Forum said France achieved a reduction of 47 percent in its road-death toll in the first decade of the century, relative to the 1990s. The ministerial report said the average speed in France also dropped 10 kilometers an hour since 2002, or 11.7 percent.

The radar cameras, however, spawned a thriving market in radar-warning devices. According to AFFTAC, 5.1 million drivers in France use them. Under the new law, users would face fines of up to 1,500 euros, or about $2,100.

The French government’s decision to not only ban radar detectors, but also to remove signs warning motorists of fixed radar cameras has generated some serious backlash. Apparently over 80,000 people “liked” the Facebook page of AFFTAC, a group opposing the measures and calling for nationwide protests, over the course of two days. By comparison, the most optimistic count of hand-raisers for a possible future Chevy El Camino is “possibly as high as 18,000 people.” Call us crazy, but we thought America’s oft-cited “love affair with the automobile” would have created some slightly different results.

A study released earlier this month by the Cascade Policy Institute questioned whether pricey mass transit options in Portland, Oregon are really being used by the public. The city has been a leader in securing funding for various forms of passenger rail and trolley systems. The Obama administration, for example, pledged $745 million in federal gas tax dollars to pay for the construction of a $1.5 billion, 7.3 mile light rail project connecting Portland to Milwaukie. Transportation Secretary Ray LaHood has singled out the city’s priorities as for praise.

“By adding innovative transit opportunities, Portland has become a model livable community, a city where public transportation brings housing closer to jobs, schools, and essential services,” LaHood wrote in March.

When Lotus showed five new cars at the Paris Auto Show last summer, the British Sports Car brand raised a number of eyebrows amongst the motoring press. Not only was Lotus abandoning its lovable but hugely unprofitable enthusiast/trackday niche, but it was also reaching for Ferrari and Porsche-style brand recognition while offering an ambitious but underwhelming (on paper anyway) vision of its future product lineup. Five new vehicles (three mid-engine, two front-engine, four two-door coupes, one four-door sports sedan) is a lot of development work, and initial reports that Lotus would use Toyota power including hybrid drivetrains didn’t create much for enthusiasts to get worked up over. Lotus has since backed away from using Toyota power, but developing engines for five new vehicles creates a whole new set of challenges. And, as it turns out, Lotus has wuietly backed away from the most ambitious elements of its plan, and the firm now plans to launch only two cars at first. Has Lotus turned the corner from hype machine to credible competitor?

The Wisconsin Court of Appeals on Wednesday gave its first ruling on how dashcam evidence would be treated at the appellate level. A three-judge panel decided that the proper legal standard when evaluating a video is to overturn a trial judge’s decision only it is “clearly erroneous.”

The context was provided by the November 4, 2009 arrest of Jeffrey D. Walli in Sheboygan. The court was asked to determine whether Sheboygan Police Officer Brandon Munnik had a valid reason for pulling Walli over in the first place. Munnik claimed that around 11:22pm Walli’s car nearly sideswiped him, so he flipped on his emergency lights, which triggered his dashboard-mounted video camera, and gave chase. Munnik testified that the resulting video showed Walli’s car over the center line and was a legitimate traffic violation. Walli’s attorney disagreed with that take.

The war of words over a possible 62 MPG 2025 CAFE standard is accelerating this week, as letters in support of the standard [sub] are vying with industry responses against the proposal for media attention. And though environmentalists are quick to point out the often-misunderstood difference between EPA and CAFE mileage ratings (a fact that even the industry-friendly Automotive News [sub] concedes, if only in a blog post], the industry’s response is miles away from any kind of compromise, saying

The alliance believes it is inappropriate to be promoting any specific fuel economy/greenhouse gas at this point

How’s that for some old-school, don’t-tread-on-me corporate attitude? No room for compromise, no sense of nuance… and yet, that doesn’t actually represent the industry’s position at all.

Members of the public are not allowed to attend red light camera trials and other proceedings at the Superior Court of California courthouse in the city of Corona. For the past several weeks a policy has been place denying entry to anyone who does not have a direct involvement in a specific case scheduled that day. Court security checks anyone attempting to enter the building.

“Please be advised that this court facility is closed to the general public,” a sign posted at the door states. “The facility conducts criminal trials Monday through Friday and only jurors, witnesses and associated trial personnel are permitted to enter. On Fridays, the facility is also open for litigants reporting for court trial on traffic or minor offense matters.”

Backroom dealing will determine whether speed camera use will become common in Missouri. The General Assembly yesterday agreed to convene a conference committee to iron out differences between House and Senate-passed versions of an omnibus transportation bill that cleared the state Senate on Tuesday. Among the the items up for debate is language that would allow any governmental jurisdiction to set up as many photo radar units as it pleases without any meaningful limitations on use.

Yesterday evening I directed some ire at President Obama’s continued reliance on ethanol as a major plank of his do-nothing transportation/energy agenda, noting

That extra money for 10,000 E15-capable pumps? That’s because no gas station owner will pay to install a pump for a kind of fuel that only cars built since 2001 can use… and which the auto industry has tried to ban. And why E15 in the first place? Because blenders can’t sell enough E10 to blend the government-mandated amount of ethanol and collect their $6b this year in “blender’s credits” to do so. A subsidy to support a subsidy which in turn props up yet another subsidy (I may have missed a subsidy in there somewhere). You can’t make this stuff up.

The “cornerstone” subsidy that all other ethanol subsidies support is the Volumetric Ethanol Excise Tax Credit, or VEETC, or “blender’s credit,” a $6b per year subsidy that directs 45 cents to refiners for every gallon of ethanol they blend with gasoline. The VEETC nearly died in December’s lame duck session, only to be revived as a way to buy votes for the President’s tax policy. Now, however, The State Column reports that a bipartisan Senate bill has been introduced that would eliminate both the VEETC and import tariffs on foreign-made ethanol. And with a rash of bad news coming out about ethanol, this could just be the opportunity to kill this wasteful government subsidy with fire.

As the graph above [via NHTSA’s latest CAFE data, in PDF here]  shows, passenger car fleet economy has actually leveled off after a brief spike in recent years. Possibly even more surprising is the fact that imports spent a portion of the last decade actually beating the imports in passenger car economy after a 20+ year slide in import CAFE performance [more long-term fuel economy charts here]. These trends illustrate that the sides in the emerging “Battle of 62 MPG” may not as easy to characterize as you might think… as does a new hint from NHTSA about the shape of future CAFE increases. According to the Detroit News, NHTSA is signaling that

it is researching the impact of raising fuel efficiency in the 2 percent to 7 percent annual range.

The agency said it has “tentatively concluded” that 7 percent annual increases is the maximum that is technically feasible.

Before it sets a requirement, NHTSA must take into account a number of factors, including the costs of the regulation and safety impacts.

NHTSA and the Environmental Protection Agency said previously they are working together on 3 percent to 6 percent annual increases.

The high end of that range would result in the much-discussed 62 MPG by 2025 standard, an achievement the government insists would only cost as much as $3,500 per vehicle. The industry points to cost estimates closer to $10,000 per vehicle for that level of CAFE increase. The battle continues…

Some taxpayer-funded turnarounds just have a little more turnaround than others, according to the GAO’s recent report on the auto bailout [PDF here], which tracks the progress of the Detroit patients and considers their futures. Sure, GM received quite a bit more government money than Chrysler, but the improvements in GM’s financial performance compared to Chrysler’s are clear. But the GAO still has a number of concerns about the “more than $34 billion” of taxpayer value that’s still floating around, unrecouped, in the rescued automakers. The Missouri state Senate yesterday voted to require local jurisdictions to adhere to minimum standards for yellow warning time at intersections. State Senator Jim Lembke (R-St. Louis), an opponent of the use of red light cameras, introduced amendments to an omnibus transportation bill designed to limit the desirability of photo enforcement. His colleagues went along with language mandating that signals on all roads adhere to the bare minimum “nationally recognized engineering standards.”

A White House blog post accompanying video of the President’s speech included a large infographic on “The Obama Energy Agenda And Gas Prices,” the transportation-oriented section I’ve excerpted above. This one section is actually a fairly good representation of Obama’s auto-related energy policy preferences, and illustrates why I often find myself criticizing the president here at TTAC.

A three-judge panel ruled Thursday that Colorado Springs, Colorado Police Officer Duaine Peters did nothing wrong in having Miriam Leverington fired from her job as a nurse at Memorial Health System for talking back after he wrote her a speeding citation.
