Legions of Toyota owners have brought their automobiles to their dealers to have their carpets zip-tied and their pedals shimmied. But did that end the customer complaints? When it comes to the cause of the alleged Toyota unintended acceleration, the TTAC commentariat is divided into two camps:

One side is convinced they know what’s wrong with Toyota. (It’s the cursed computer. May it roast in hell and grow tin whiskers.)

The other side isn’t so sure and argues for caution. It could be pilot error. Plain old hysteria also isn’t ruled out. Or some trade warfare that reared its no so pretty head at yesterday’s hearings: “You block our beef because of mad cow disease. We do the same to your cars.”

Tomorrow the Senate will be taking its shot at the Toyota scandal, with hearings scheduled before the Committee on Commerce, Science & Transportation. Giving testimony will be three Toyota executives including Yoshimi Inaba, NHTSA Administrator David Strickland and Clarence Ditlow of the Ralph Nader-founded Center for Auto Safety. Conspicuously absent from the list is Dimitrios Biller, the former Toyota lawyer who claims that Toyota hid documents related to vehicle design from discovery in several suits against the automaker. The House Oversight Committee has reviewed a number of Toyota communications courtesy of Biller, and a letter from chairman Ed Towns (D-NY) demands that Toyota answer Biller’s charges [Towns’ letter and Biller documents in PDF format here, courtesy of DetNews]. By invoking Biller’s charges, Towns has dragged yet another witness into the fray whose story raises more questions than it answers [one of Biller’s several suits against Toyota can be found here.] And yet, probably because of his complex backstory] there are no plans for Biller to testify under oath before congress. Should he, or does his testimony just cloud the picture even further?

„Itai!“ Or rather, „tong!“ Ouch, that hurts: Toyota boss Akio Toyoda bowed deeply to 300 reporters assembled in Beijing, and to 1.3b Chinese who could watch the drama live on national TV. Four times in one hour, Toyota’s chief  “apologized to customers in China for the company’s quality problems and emphasized the significance of the nation’s fast-growing market to his company,” as Shanghai Daily has it. Surprisingly good news out of Japan: Seemingly unimpeded by the Toyota-bashing, production of cars, trucks and buses in Japan increased 30.7 percent on year in January. Output is up for the third consecutive month, the Japan Automobile Manufacturers Association said today via The Nikkei [sub]. Vehicle output rose to 753,773 vehicles in January from 576,539 vehicles in the same month a year earlier.

Even better fared Japan’s exports of cars, trucks and buses: Exports shot up 45.6 percent from a year earlier in January, the first rise in 16 months, says The Nikkei [sub] in a separate report. “Shipments to key markets such as Asia, Europe and” – gasp – “North America increased in line with recovering auto demand.” To this embedded observer, it seems as if the jobs created by this brouhaha are in Japan.

One of the most important lessons to come out of the last two days of congressional hearings on the Toyota recalls is that blaming individuals for unintended acceleration is too tough a task for our elected representatives. And yet the more we learn, the more necessary it seems to take human error into account when dealing with unintended acceleration. Nothing illustrates this quite like the case of the very first witness to give testimony before congress. Rhonda Smith of Sevierville, Tn told the House Energy Committee, under oath, that her Lexus ES350 became “possessed” and that its brakes and transmission failed to respond at precisely the moment that the car accelerated out of control. “Shame on you, Toyota, for being so greedy,” she said, wiping tears from her eyes. But it turns out that the shame belongs almost entirely with Ms Smith.

The Wall Street Journal [sub] [via Jalopnik] reports that, despite her traumatic and inexplicable experience, Ms Smith sold her dangerous, out-of-control ES350 to another family, which has since put 27,000 trouble-free miles on the vehicle (according to just-auto [sub], Toyota has since taken possession of the vehicle). Which means she either lied under oath, or displayed a disregard for the safety of others that puts Toyota’s missteps into stunning context. Or both. In any case, her behavior adds to our growing suspicion that the vacuous, disingenuous, and self-serving congressional hearings have been the best thing to happen to Toyota PR since the recalls began. Shame on you, Rhonda Smith, shame on you.

News that the FBI had raided three Japanese supplier companies in the Detroit area came in the middle of yesterday’s epic Toyota hearings, adding to the day’s chaos and misinformation. The FBI said clearly at the time that Denso, Tokai Riko and Yazaki were raided as part of an antitrust investigation, which we now know [via Reuters] involves alleged cartel activities in the wiring harness supply market, and involves European firms like France’s Leoni as well. Despite the fact that Denso and Yazaki are cooperating with investigators, and that the US raids appear to be in support of an EU investigation, Rep Mark Souder (R-IN) took the opportunity to connect the Denso raid with the Toyota recall hearings in shameless style. And all to help clear the name of the US-based supplier CTS, which has been blamed for the sticky pedal recall, which just so happens to be in Rep. Souder’s district. QOTD is a fairly irregular exercise for us, but we’d be remiss if we didn’t dust it off for today’s marathon hearings before the House Oversight and Government Reform Committee. Needless to say, the ten-ish hour affair offered too rich a bounty of choice quotes to properly choose just one. And so we have two: the first and one of the last quotes of the day’s proceedings. The day opened with the following words from Chairman Edolphus Towns:

Good morning. I thank you all for being here. It is hard to imagine the horror of the event that took the lives of an entire family near San Diego, California on August the 28th, 2009. California highway patrolman, Mark Saylor, his wife, their 13 yr old daughter, and Mrs Saylor’s brother, Chris, were driving in a Toyota Lexus, a loaner car that the Toyota dealer provided while their car was being repaired. As they drove along the highway, suddenly the car… accelerating [sic] rapidly, he stood on the brakes, but nothing happened. No matter what he did, he could not stop the car from flying down the road, faster and faster. As this car reached top speed in just seconds, it was all he could do just to kep it under control. In a frantic call to 911, his brother-in-law, Chris, reported the gas pedal was stuck, the brakes did not work, and they were barreling down on an intersection. He yelled over the phone “hold one, hold on, hold on and pray. And those were his last words.”

I am Akio Toyoda of Toyota Motor Corporation. I would first like to state that I love cars as much as anyone, and I love Toyota as much as anyone. I take the utmost pleasure in offering vehicles that our customers love, and I know that Toyota’s 200,000 team members, dealers, and suppliers across America feel the same way. However, in the past few months, our customers have started to feel uncertain about the safety of Toyota’s vehicles, and I take full responsibility for that. The House Energy and Commerce Committee kicks off the week’s Toyota-related festivities on Capitol Hill today, with the first round of hearings scheduled for 11 am Eastern. Testifying will be Toyota Motor America’s Jim Lentz, Transportation Secretary Ray LaHood, Southern Illinois professor and ABC’s ghost hunter David Gilbert, Safety Research and Strategy’s Sean Kane, as well Eddie and Rhonda Smith, who reportedly experienced uncontrollable sudden acceleration in a Lexus ES350.  The E&C Committee has a live webcast available here, or you can watch on C-Span 3. The Detroit News’s David Shepardson is live-tweeting from the press events on the Hill leading up to the hearing.

Tomorrow is the main event, when CEO Akio Toyoda appears before the House Oversight Committee along with TMA President Yoshimi Inaba.

Ever since Toyota’s recent problems hit “frenzy” level on our mainstream media monitoring system, speculation has been rampant that some mysterious electronic problem was at the root of the unintended acceleration scandal. We’ve been wary of jumping on the “ghost-in-the-machine” bandwagon, for a number of reasons, chief among which is the fact that it seems to be the product of an inability to explain specific instances of unintended acceleration, rather than hard evidence. Given that unintended acceleration occurs at the intersection of man and machine, good old-fashioned human error is an easier assumption than mystery software errors. Given the worrying results of our Toyota gas pedal analysis, we’ve been content to explain the situation on a combination of pedals, mats and human error. But now ABC News may just have the first positive evidence of an electronic problem that could explain the mystery behind Toyota’s unintended acceleration problem. Dave Gilbert of Southern Illinois University has found that it’s possible to cause unintended acceleration without it triggering an error code that might give some kind of clue as to its cause. Combined with our finding that Toyota actively conceals data from its black box data recorders (out of line with standard industry practice), this could be some of the first positive evidence that there’s more to the “ghost in the machine” theory than mere panic-driven speculation.
