A final rule for 2017-2025 CAFE standards won’t be published until September, but a pre-publication notice by the EPA [PDF here] reveals some of the key details we’ve been looking for. The broad strokes, which we are already well aware of are shaping up as follows:

NHTSA currently intends to propose standards that would be projected to require, on an average industry fleet wide basis, 40.9 mpg in model year 2021, and 49.6 mpg in model year 2025.  For passenger cars, the annual increase in stringency between model years 2017 to 2021 is expected to average 4.1 percent, and to average 4.3 percent between model years 2017 and 2025. Like EPA, in recognition of the utility requirements of full-size pick-up trucks and the unique challenges to improving fuel economy compared to other light-duty trucks and passenger cars, NHTSA intends to propose a lower annual rate of improvement for light-duty trucks in the early years of the program. For light-duty trucks, the proposed overall annual rate of fuel economy improvement in model years 2017 through 2021 would be 2.9 percent per year.  NHTSA expects to change the slopes of the fuel economy footprint curves for light-duty trucks from those in the 2012-2016 rule, which would effectively make the annual rate of improvement for smaller light-duty trucks in model years 2017 through 2021 higher than 2.9 percent, and the annual rate of improvement for larger light-duty trucks over the same time period lower than 2.9 percent.  For model years 2022 through 2025, NHTSA expects to propose conditional standards with an overall annual rate of fuel economy improvement for light-duty trucks of 4.7 percent per year

We had heard that trucks would improve their efficiency at a rate of 3.5% rather than 2.9% for the 2017-2021, and a 2022-2025 growth rate of 5% rather than 4.7%. But then, cars were supposed to improve by 5% in the 2017-2025 period, so both truck and car standards seem likely to end up lower than what the president’s report seemed to promise. But that’s not the only bad news for anyone hoping for tough fuel efficiency standards (or, good news for truck-dependent automakers)… with the release of this notice, we have an initial sense of the loopholes that will be included, and they appear to be of the hefty variety.

Every morning, children who walk to school are familiar with the smiling, friendly faces and the outstretched arms of their local crossing guard who ensures they get safely to class each day during the school year.

But what do crossing guards do when school’s out for summer?

At least some of the friendly faced school crossing guards are spending their summer vacation writing parking tickets to Chicago drivers on behalf of the city.

It began as a pilot program last summer, and as a way to give crossing guards a way to continue to bring in a paycheck when school was finished in June, according to Crossing Guard Coordinator John Maciezjewski, a retired police officer. This year it has been rolled out city wide to give summer employment opportunities to the over 1100 crossing guards working for the city.

Today’s wild-ass rumor of the day really lives up to its wild-ass billing, combining equal parts conspiracy theory and ressentiment for a high-proof cocktail of crazy. In a blog (i.e. not very well thought-through) item at Automotive News [sub], Industry Editor James Treece primes the loco pump with an intriguing proposition:

Some commentators and bloggers assume that ownership explains what goes on in the auto industry. They argue that GM and Chrysler management have repeatedly bowed to the desires of their government and union owners over the last two years, and that government ownership has perverted the market in other ways as well.

Well, if that’s so, it’s fair to ask the same question about the latest fuel-economy rules — and the companies that oppose them.

Already the crazy is starting to show: the Detroit automakers are widely recognized to be the chief beneficiaries of the “compromise” modifications to Obama’s proposal. So if government-owned automakers didn’t actually roll over for regulators, why legitimize the crackpot theories of “some commentators and bloggers”? Because Treece has a crackpot theory of his own…

With the high political drama surrounding America’s debt ceiling crisis, last Friday’s CAFE announcement received much less attention from the media than it might have. But, flying even further beneath the radar is an attempt by Republicans to undo the fuel economy agreement that was the result of long negotiations. According to the NYT, some 39 “anti environmental” riders were attached to an Interior Department and EPA appropriations bill, including one which reads

Sec. 453. None of the funds made available under this Act shall be used— (1) to prepare, propose, promulgate, finalize, implement, or enforce any regulation pursuant to section 202 of the Clean Air Act (42 U.S.C. 7521) regarding the regulation of any greenhouse gas emissions from new motor vehicles or new motor vehicle engines that are manufactured after model year 2016 to address climate change.

Though one rider, which would have prevented any new listings on the Endangered Species Act lists of threatened and endangered species, was defeated, the NYT reports that the fuel economy rider is still pending. Politico adds that the bill is scheduled to go to the House floor today, but that President Obama is already threatening to veto the bill. Having worked with California, environmental groups and the auto industry to hammer out a compromise, it’s unlikely that the White House will approve any final bill that includes a measure to gut the new 2016-2025 standard… but the fact that Republicans are trying to eliminate the EPA’s ability to regulate fuel economy indicates that someone, somewhere wouldn’t mind seeing the newly-approved CAFE standard gutted.

The Village of Palatine, Illinois prints the personal information of vehicle owners — including their address, driver’s license number, date-of-birth and weight — on parking tickets left under the windshield wipers of their automobiles. In a ruling handed down last month, the Seventh US Circuit Court of Appeals found no problem with this procedure.

Motorist Jason Senne had filed suit against what he saw as an outrageous violation of privacy after he received a $20 parking ticket in August 2010. The information printed on the citation, and left open to anyone walking past his vehicle, could be used by an identity thief. Senne argued this was a violation of the federal Driver’s Privacy Protection Act which prohibits disclosure or otherwise making available the information found in motor vehicle records.

The dwindling and demoralized ranks of Saab flagwavers had a bad week. No cash in the kitty, bankruptcy looms, their savior Vladimir Antonov is rebuffed by the European Investment Bank, dirty laundry about funds seeping away to hot islands is being aired. Their hopes now cling to a sheet of paper. Today, Christer Gerlach wrote an op-ed piece in Sweden’s Dagens Nyheter in which he makes the case that Saab should not be written off just yet. He is asking the Swedish government for help. A translation is printed at Saabsunited.

Christer Gerlach is a famous autowriter. The 66 year old Swede became notorious in 1972 by crossing the Sahara in a Citroen 2CV. In 1988, he entered the Guinness Book of World records in a solo trip around the world – in a Toyota Corolla. If you want the impossible on four wheels, Gerlach is the man to call.  I would not call him to restructure a moribund car company. (Read More…)

With congress deadlocked on the debt ceiling, President Obama used today’s ceremony announcing (although not fully revealing) a 2025 CAFE standard to contrast fuel economy standard negotiations with the chaos on Capitol Hill. ABC quotes the President saying

You are all demonstrating what can happen when people put aside differences.  These folks are competitors.  You’ve got labor and business.  But they decided:  We’re going to work together to achieve something important and lasting for the country. So when it comes to tackling the deficit or it comes to growing the economy… the American people are demanding the same kind of resolve, the same kind of spirit of compromise, the same kind of problem solving that all these folks on stage have shown. They’re demanding that people come together and find common ground… That’s what I’m fighting for.  That’s what this debate is all about.  That’s what the American people want.

But getting a bunch of auto CEOs in the same room to agree on one 2025 “number” is a lot easier than breaking a political deadlock: after all, the standard could well be changed during the 2017 review period, so nobody is agreeing to anything set in stone past 2016. And the saber-rattling continues, as industry consultants predict doom for the post-2016 period, when the truck standard hits the same 5% annual improvement rate as cars. Besides, Volkswagen and Daimler are the equivalent in this situation of holdouts in the congress, refusing to appear at today’s ceremony and protesting the proposed standard in the media. And when the final rules is announced, this coalition of exemplary compromise could fall apart, as the Sierra Club threatens

As the administration moves forward to finalize the standard, it is critical that they avoid weakening loopholes and giveaways for the industry, and we look forward to working with them to ensure the strongest 2025 fuel efficiency and pollution standards possible to benefit American families and workers.

Defections on the right and left? Continued saber rattling? No concrete agreement yet in any case? Sounds a lot like congress, actually…

The announcement of President Obama’s proposed 54.5 MPG 2025 CAFE standard was hailed nearly unanimously today in a ceremony attended by many auto industry executives as well as government officials. Volkswagen and Daimler were conspicuous by their absence, as the Bloomberg quotes VeeDub spokesman Tony Cervone arguing

The proposal encourages manufacturers and customers to shift toward larger, less-efficient vehicles, defeating the goal of reduced greenhouse-gas emissions,

while Reuters notes Daimler’s response

Mercedes-Benz, the luxury car line owned by German car and truck maker Daimler, did not back the new program, saying it “clearly favors large SUVs and pickup trucks.”

“Our customers expect a range of vehicles from which to choose so this program creates a very real disconnect between government regulation and customer demand,” the carmaker said in a statement.

But are these concerns well-grounded? We don’t know yet, as the details of the proposal (specifically the loophole details) have not yet been released. Instead of publicizing the full rule, the White House released a report [PDF], highlighting the easy-to-like aspects of the proposed rule. But how easy-to-like is the standard really?

SvD.se reports that would-be Saab rescuer Vladimir Antonov is considering legal action against the European Investment Bank and the Swedish Government, for keeping him out of an ownership stake at the failing Swedish automaker. Says Antonov

I have therefore decided to investigate the possibility of taking legal action, including but not limited to claims for damages, which may be of interest to various parties, including myself, the EIB, some officials at the EIB, the Swedish government and some government officials personally. By denying SWAN (Swedish Automobile) and Saab Automobile access to the funding that I offer, what these companies want and still desperately want, both the Bank and the Swedish government acted against all involved parties concerned, particularly against Saab and SWAN’s employees , suppliers, traders, lenders and shareholders

Antonov is reportedly investigating whether he can sue individual ministers of the Swedish government, while the ministers in question angrily deny that they are working against the interests of the Swedish auto industry. Meanwhile, far from calling for the overthrow of the government, the Swedish press is investigating Saab’s outlays for “management services” in recent years, and has found that CEO Victor Muller may be siphoning cash off to the tax haven of Curacao.

Backers of ballot initiatives that would ban photo enforcement in a number of cities in Washington state are fighting back against municipal efforts to silence their vote. Traffic camera companies have become increasingly bold in their efforts to prevent the public from deciding whether red light cameras and speed cameras should be used in any given community.

American Traffic Solutions (ATS) scored its first victory in May when it found an activist judge in Chelan County willing to block residents from even filing a petition to their government regarding the use of traffic cameras in the community (read decision). Just days after the decision came down, the state supreme court discussed traffic camera initiatives, and several justices pointed out that blocking signature collection efforts would be a violation of the state constitution. Nonetheless, to bypass the legal blockade, initiative co-sponsor Matt Ericksonis circulating a second petition that schedules an advisory vote on taking down the cameras at every election until the devices are finally removed.

After the apocalyptic warning from the industry about a proposed 56.2 MPG 2025 CAFE standard, the auto industry seems to be backing the White House’s latest proposal, which reduces the 2025 target to 54.5 MPG, slows the rate of efficiency improvement for trucks and increases advanced technology credit loopholes. Another key consideration: the White House agreed to a mid-term review of the 2025 standards to ensure they reflect the market. Plus, the DetN points to a previously unheard-of compromise to keep big trucks cheap:

The plan is also carving out special rules for “work trucks” — heavier light duty vehicles used for construction.

As a result of these compromises, the WSJ [sub] reports:

As of Wednesday, Toyota Motor Corp., General Motors Co., Ford Motor Co., Chrysler Group LLC, Honda Motor Co., Hyundai Motor Co., Nissan Motor Co., BMW AG and Volvo had told the administration they would support the plan

With the industry now largely on board, the Obama Administration has a green light to announce its new standard at a ceremony planned for tomorrow. But not everyone is happy with the new proposal…

Red light cameras are coming down in Los Angeles, California after midnight on Sunday. The city council yesterday voted unanimously to drop the program primarily over the county court system’s refusal to enforce unpaid tickets, depriving the city of millions in expected revenue. The council instructed the city attorney to work with American Traffic Solutions (ATS) to decide the cheapest way to remove the systems and process all tickets issued through the end of the month.

“We need to be clear about what we are doing here today with this particular vote,” Councilman Dennis P. Zine said. “I don’t want to give the wrong perception to the public that this program may continue in the future. As I noted, photo red light will be gone in four days. Cameras need to come down immediately to not create a smokescreen to affect the hope that we may turn them back on.”

The LA Times reports:

The City Council voted unanimously Wednesday to halt Los Angeles’ controversial red-light camera program, which has ticketed more than 180,000 motorists since beginning in 2004. The program will officially end July 31.

The action followed a similar vote last month by the city Police Commission, which sought to drop the 32-camera program in part because of the difficulty in collecting fines.

But wait, the news gets better! Earlier today, the LAT helped bust the photo enforcement program wide open, reporting:

City officials this week spotlighted a surprising revelation involving red-light camera tickets: Authorities cannot force violators who simply don’t respond to pay them. For a variety of reasons, including the way the law was written, Los Angeles officials say the fines for ticketed motorists are essentially “voluntary” and there are virtually no tangible consequences for those who refuse to pay.

It’s a little more complicated than that, but those are the broad strokes.

Do we really need one?

Opinions vary widely. In recent years, there have been two legislative efforts to convert the ubiquitous state driver license into a national ID card, making it the essential “show us your papers” document in order to navigate in, around, and through our society.

At the other end of the spectrum, a current movement to do away with the driver license altogether may seem impractical, but it is gathering momentum in regions around the U.S.

Which should it be – a federally-mandated document that uniquely identifies its holder and is necessary to provide the right to drive, to fly, and to participate in various governmental programs, or an extraneous card that serves no useful purpose in a society where individuals have the right to travel without restrictions?

Let’s examine these two diametrically opposed positions:

The one man most responsible for the spread of red light cameras in the United States is now enjoying the fruit of his labor. Richard A. Retting was New York City’s deputy assistant commissioner for traffic safety programs as the Big Apple considered becoming the first in the US to operate intersection cameras. Planning for the program began in 1983 and continued through 1991 when then-Mayor David Dinkins activated the system. For this achievement, Retting was dubbed the father of the red light camera in America, and today he is earning money directly from the systems that have followed New York’s lead.
