A number of states are considering legislation that would outlaw the use of photo enforcement. Last year alone, Maine, Mississippi and Montana added themselves to the list of fifteen states where red light cameras and speed cameras are no longer welcome. On Thursday, the South Dakota House Transportation Committee will consider legislation introduced by state Representative Peggy Gibson (D-Huron) to make her state the sixteenth.

Supreme court justices in Missouri yesterday openly questioned the constitutionality of the red light camera program in the city of Springfield. The high court heard oral arguments in the case of retired highway patrol officer Adolph Belt, Jr. who attempted to defend himself in a court of law against the automated citation he received in the mail from Lasercraft, a UK-based camera vendor. Springfield insisted that Belt had no such right and that an administrative hearing presided over by a municipal judge constituted the first and last appeal in the matter. This procedure raised eyebrows among members of the high court, as administration represent a function of the executive.
An automated enforcement company is turning to an unelected branch of government to re-write Arizona law regarding proper service for traffic tickets. Redflex Traffic Systems of Melbourne, Australia convinced John D. Wintersteen to file a petition earlier this month that asked the Arizona Supreme Court to modify the state’s rules of civil procedure to better accommodate red light cameras and speed cameras.
“Unlike the majority of other jurisdictions that have implemented photo enforcement, Arizona’s rules governing service of process have not been simplified to accommodate the unique challenges presented by the widespread use of photo enforcement equipment,” the petition prepared by Redflex lawyers stated. “Rule 4.1 does not currently allow defendants in photo enforcement proceedings to be validly served with a copy of the summons and pleading by first-class mail.”

The city of Red Bank, Tennessee voted Tuesday to extend its automated ticketing contract with American Traffic Solutions (ATS) for twelve years, in open defiance of the state legislature. Earlier this month, the House Transportation Committee gave its approval to proposed legislation that would place a temporary moratorium on red light camera and speed camera program renewals while a set of engineering and operational standards are developed to ensure statewide uniformity. The committee took great pains to ensure that no city would be deprived of any existing red light camera or photo radar revenue by refusing to ban any existing practices.
The Tennessee House Transportation Committee yesterday drafted a legislative proposal that will solidify the legal standing for the use of both speed cameras and red light cameras in the state. After a lengthy markup process, committee members approved a two-year moratorium on new cameras while ensuring that there is no disruption in ticketing for cities like Chattanooga, Clarksville, Jonesborough and Knoxville that already have programs in place. In 2008, the state legislature quietly gave the green light to jurisdictions interested in installing red light cameras and speed cameras, but even the lawmakers most in favor of the use of cameras have been pressured by the public to take some action to reign in their use.
California Governor Arnold Schwarzenegger, desperately seeking new sources of revenue to cover a $19.9 billion budget shortfall, yesterday declared a state of fiscal emergency. As part of his proposed solution, Schwarzenegger called for the deployment of a massive statewide speed camera program to generate at least $397.5 million in net profit to state and local government.
Under the proposal, existing red light cameras at intersections would be converted into “speed on green” cameras that issue citations to motorists who try to speed up at an intersection to make the light. Those who slow down and fail to make the light will be mailed a red light camera ticket.
“Various federal rules are tying our hands and preventing us from reducing costs in some state programs,” Schwarzenegger explained at a news conference yesterday. “I want to remind the federal judges and the politicians California is not Washington. We do not have the luxury of printing money or running trillion-dollar deficits.”
In 2007, the Virginia Department of Transportation (VDOT) performed one of the most comprehensive statewide surveys of the impact of red light cameras on safety (view report). It caused quite a stir upon its release. The study took advantage of seven years’ worth of data both before and after cameras were installed, examining a far more extensive dataset than most competing studies.
Despite the agency’s best effort to present automated enforcement in a positive light, the unavoidable results were that, on a statewide level, accidents and injuries increased where cameras were used. This outcome has proved to be an embarrassment for the Insurance Institute for Highway Safety (IIHS) which has been the primary organization generating research claiming that red light cameras improve safety. IIHS noted that VDOT essentially bent over backwards to accommodate the industry, but because the ultimate results were unfavorable, the VDOT report should be discarded.
A class action lawsuit was filed Monday against Bradenton, Florida and American Traffic Solutions (ATS) seeking to end the use of red light cameras in the city. Attorney Jason D. Weisser challenged the program on behalf of motorist Jamie Rosenberg and all other recipients of $125 photo tickets since automated ticketing machines were installed in March 2008.
A number of Texas cities are exploiting short yellow timing at intersections, generating significant additional revenue, according to a review of Texas Department of Transportation (TxDOT) data by TheNewspaper. The citation issuance rate at the nine intersections with the shortest yellow timing in the state was four times greater than the ticket issuance rate at locations that offered yellow times exceeding statewide averages.

The Federal Highway Administration (FHWA) last month issued an official ruling that found red light camera “violation lines” illegal. A number of jurisdictions across the country paint four-inch wide white lines on the pavement at what is known as the “prolongation” of the cross street’s curb line in order to facilitate the use of automated ticketing machines. These are not the “stop bar” or crosswalk lines that most motorists expect, but a third set of lines that appear at the very edge of the intersection.
Beginning around 4am Friday morning, about 250 speed cameras throughout The Netherlands were gift-wrapped in festive boxes that prevented the devices from issuing automated tickets. The cameras were thus decorated as part of a publicity stunt for the “Go Fast” energy drink with the help of about seventy company employees. Many of those involved dressed either as Saint Nicholas or Zwarte Piet as they went about their work, costumes appropriate for the eve of the feast of St. Nicholas. In a previous stunt, several speed cameras had “Go Fast” advertising stickers placed on them — most of which are still in place. This time, however, police were quickly dispatched to remove the cardboard gift boxes so that ticketing could resume.
In England, vigilantes on Tuesday used a gasoline-soaked tire to burn a speed camera in Leigh at around 11pm. The automated ticketing machine was located on London Road near the Elms pub, The Echo reported. Police have no suspects.

Red light cameras are shutting down temporarily and permanently in a pair of California cities. Santa Maria’s program has ended for good, thanks to camera vendor American Traffic Solutions (ATS). ATS inherited the Santa Maria account from bankrupt vendor Nestor Traffic Systems in September and has now decided to pull out of the city because it was not earning enough revenue.

In the United States, where motorists don’t face the daily challenges they do in Russia, discussions of politics in an automotive forum too often gets overwhelmed by larger political battles. Before you know it, a conversation about the future of electric cars can turn into a debate on military and foreign policy, and an auto-industry bailout can be justified by virtue of its small size relative to the bank bailout. In short, everything happens within a context, and politics is all about context. Accidents rose after the installation of a red light camera at one major intersection in Baytown, Texas. The private company American Traffic Solutions began issuing automated tickets at the intersection of Garth and Baker Roads on March 21, 2008. Since then, safety has not improved at the controversial camera location.
According to a brochure published by the city, “red light safety cameras” were installed because, “There have been more than 1,000,000 accidents and more than 1000 deaths attributed to red light runners that occur each year in the United States.” Presumably, the cameras are meant to reduce the number of collisions and deaths at Baytown intersections.
This has not happened according to accident reports from all three monitored approaches of the Garth and Baker intersection from eighteen months before the installation of cameras compared to the same period afterward. Instead, the total number of collisions grew by 11 percent. Although proponents of cameras frequently suggest that the increase in rear end collisions (31 percent in this case) is offset by the reduction in “more serious” collisions, the data show, to the contrary, that there was no reduction at all in the number of serious injury accidents.
Traffic camera companies operating in Arizona may be committing a crime by operating without a private investigator’s license, a newly released memorandum to the state legislature explained. The non-partisan Arizona Legislative Council, the legislature’s official source for drafting and reviewing legislation, looked at the licensing question on behalf of state Representative Sam Crump (R-Anthem).
