Senator Debbie Stabenow has introduced S. 3715, known as the Charging America Forward Act, which would extend tax credits for plug-in vehicles until 2014 and “front load” the credits, to create a dealership-level discount, among other provisions. Though inspired by President Obama’s call to put a million plug-in vehicles on the road by 2015, Stabenow’s website plays up a single, all-important angle to the bill

Michigan is already a leader in emerging hi-tech battery and electric car production. Other countries are acting to develop their own advanced vehicle markets because they realize the tremendous economic potential this new technology represents.  These initiatives will allow Michigan innovators to continue to out-compete the world and create new jobs here

Though the full text of the bill hasn’t hit Govtrack yet, the DetN reports that it’s chock full of plug-in subsidies, so it seems that Stabenow’s proposa is considerably more dramatic than the recent plug-in credit extension introduced by Rep Sander Levin. And that’s not necessarily a good thing…

The Maryland Court of Appeals ruled on January 24 that officers who received speed camera tickets while driving police cars on duty must pay the $40 fine. Montgomery County Officers Dean Cates, Randy Kucsan, Bill Tran, and Dana Way protested after their department reissued citations in their names in 2008. They were found guilty in district court, but a circuit court judge dismissed the charges on the grounds that the officers were denied their due process rights. The state appealed, hoping the court would rule that police officers are not entitled to due process before liability for a speed camera ticket is transferred.

Under county policy, speed camera tickets are re-issued to the policemen, paramedics and firemen who were behind the wheel of police cars, ambulances and fire trucks if the emergency lights on the vehicles were not visibly activated in the photograph. The officers complained that their sergeant would ask them weeks or months after an alleged offense to explain why they were speeding. Read More >

You want the good news or the bad news first? OK, the good news is that Fiat/Chrysler CEO Sergio Marchionne told attendees at NADA’s annual convention that Fiat and Chrysler “may” be merged into a single company, possibly headquartered in the US. Which means the federal bailout may not have simply been a transfer of the firm to Italian ownership, news that many taxpayers likely find at least a little bit comforting. Now, about that bad news… while saying that he planned to “work his [rear end] off” to pay back taxpayers, Marchionne let slip a bit of the resentment he clearly feels at government ownership of Chrysler, saying

I am paying shyster rates. We had no choice… I am going to pay the shyster loans.

Jalopnik does a good job of covering the roots and associations of Marchionne’s choice of words (and clearly he could have chosen better), but we’re mostly irked by the victim complex embraced by executives of the bailed-out automakers, especially in Marchionne’s case. The Fiat CEO was given 15 percent in Chrysler for no cash down, and will be able to take control of the automaker for a tiny fraction of its actual value. All this was possible only because the government guided Chrysler through bankruptcy, crammed down its bondholders, demanded union concessions and injected tens of billions into the company… and now Marchionne wants to employ slurs to complain about the fact that some of that money must be paid back?

These comments cloak Marchionne in the gravitas and respectability of someone who believes he should be able to receive unemployment benefits without actually looking for a job. Especially considering that only yesterday Marchionne was slamming GM for turning down DOE loans, saying

I have neither the arrogance nor the cash to show any disdain toward the DOE process. It would be wiser to Chrysler to continue to try to secure that funding.

Given that public support for the bailout is still quite low, Marchionne’s comments could hardly have been more poorly chosen.

In the face on an onslaught by the insurance and traffic camera lobbyists to convince the public that red light cameras and speed cameras save lives, state lawmakers around the country are fighting back. Representatives in Florida, Iowa, Missouri, Washington and Virginia from both the Democratic and Republican parties have noted the lack of effectiveness of automated ticketing machines in their respective states and have proposed severe restrictions or outright bans on their use. Later today, the Virginia House Militia, Police and Public Safety Committee will discuss legislation that places a moratorium on further red light camera deployment in the commonwealth.

“No locality shall implement or expand a traffic light signal violation monitoring system on or after July 1, 2011,” House Bill 2327 states.

The DetNews points us to a Treasury Inspector General for Tax Administration report [full document in PDF format here] that reveals

Approximately $33 million in credits for plug-in electric and alternative-fueled vehicles credits were erroneously claimed by at least 12,920 taxpayers through July 24, 2010, according to a report publicly released today by the Treasury Inspector General for Tax Administration (TIGTA).

That means about 20 percent of the $163.9 million in credits claimed by taxpayers from January 1, 2010 to July 24, 2010 for plug-in electric and alternative motor vehicle credits were claimed in error.

The erroneous claims TIGTA identified resulted from inadequate IRS processes to ensure information reported by individuals claiming the credits met qualifying requirements for vehicle year, placed in-service date, and make and model. TIGTA’s review of electronically filed tax returns identified individuals who erroneously claimed the same vehicle for multiple plug-in electric and alternative motor vehicle credits or claimed an excessive number of vehicles for personal use credits.

Surprised? Don’t be. President Obama’s goal of getting a million EVs on the road by 2015 is headed nowhere without some serious changes, as the OEM EVs are stuck with high prices in the short term and capacity ramp-ups in the middle term. Making progress on either the price point or the production numbers (both of which are necessary to punch EVs into the mainstream) isn’t going to happen unless gas prices skyrocket or, as Nissan CEO Carlos Ghosn puts it, government “jump starts” the market. Now, Automotive News [sub] reports that an Indiana University study argues that Obama’s million-EV goal might not be accomplished by 202 without further government assistance. On the other hand,

With increased government intervention and perhaps a global surge in oil prices, electric vehicles could capture as much as 15 percent of the U.S. market by 2025-30

By which point, the CAFE standard could well be 62 MPG combined (unadjusted)… making the argument for EVs even tougher. But now we’re getting ahead of ourselves…

The Insurance Institute for Highway Safety spent all of yesterday touting its report on the effectiveness on red light cameras as if it were the most “comprehensive” study available on the topic. The group emphasized the effects cameras would have had on one hundred of America’s largest cities, but the report itself only looked at accident numbers in fourteen out of the 500 jurisdictions that have active photo ticketing programs. Industry researchers did not even know how many red light cameras were in use in the locations studied.

“Attempts were made to obtain historical information on the number of red light cameras in the study cities, but information on the scope of red light programs could not be obtained for many of the cities,” the IIHS study explained (page 9).

My home state of Oregon has the unfortunate distinction of pioneering the practice of pay-permile taxation, having studied the GPS tracking approach to road taxes in a pilot program back in 2005-2007. Originally, the track-and-tax scheme was envisioned as a replacement for the gas tax, but now it’s being raised as a way of taxing motorists who go without gasoline altogether. The Eugene Register Guard reports

A bill before the Oregon Legislature aims to deal with the government’s potential beefs with a growing fleet of cars and trucks that never stop for fuel at a gas station: that they don’t ever pay the gas tax that helps cover the cost of state and local road construction and maintenance.

Under House Bill 2328, those drivers would pay a “vehicle road usage charge,” starting with model year 2014 electric vehicles and plug-in gas-electric hybrids.

Proponents say the bill will build on lessons learned from the pilot testing, and avoids the legitimate concerns about pay-per-mile which were first raised by the pilot project’s report. But does taxing EVs actually make sense, or is this just the politically-palatable first step towards an Orwellian nightmare of GPS vehicle tracking? Meanwhile, doesn’t the State of Oregon give up to $750 in tax credits for EV purchases? Mixed messages much?

The automated enforcement industry has suffered significant setbacks in the past several months. In November, voters in America’s fourth largest city, Houston, Texas, used the referendum process to outlaw automated ticketing machines. A number of California cities have been dropping red light camera programs after experiencing mediocre safety results. Now one of the key industry players, the Insurance Institute for Highway Safety (IIHS), is fighting back with a report released today claiming that with more red light cameras “a total of 815 deaths could have been avoided.” The IIHS report, however, did not actually consider a single red light camera accident.

Though I’m generally too much of a libertarian to be a huge fan of the work of the neo-prohibitionists at Mothers Against Drunk Driving, this in-car breathalyzing technology is definitely the kind of active-safety mandate I can get behind. After all, the social debate over the the effects of and responsibility for drunk driving has taken place, and despite heavy penalties against it, drunk driving still kills too many people. Unfortunately, since this technology won’t be usable for another ten years, we’re all going to have to live with the risk of drunk drivers for quite a bit longer… and by the time this hits the streets, you had better believe that distracted driving will be a far more relevant risk factor. After all, if the current state of debate over distracted driving were compared to the drunk driving debate, the automakers would still be arguing that in-car kegerators help keep the danger out of in-car drinking… and the government would be working to set voluntary safety standards for those kegerators.

The moral of the story: by the time we recognize societal safety problems as real problems, we are already halfway to solving them… and the final 50 percent of the problem can take years afterwords to solve.

Poor Ray LaHood. Having endured considerable embarrassment over his department’s handling of the Toyota Unintended Acceleration recall, all the Secretary of Transportation seems to want to do is talk about the “epidemic” of distracted driving. But, as TTAC has continually reminded, changing driver behaviors is a notoriously tricky task. The government’s choice: mandate intrusive measures like in-car cell phone blocking or continual surveillance of all vehicles, or go for voluntary “cures” that don’t even begin to address the underlying problem of increased driver distraction. And despite repeatedly referring to distracted driving in epidemiological terms, LaHood seems to prefer the “it’s actually your problem” approach, telling automakers [via AN [sub]]that NHTSA will

issue voluntary standards to handle the dangers of the connected car… in the third quarter of 2011.

Which means that nothing meaningful will ever actually be done about distracted driving. After all, the automakers contend that drivers will use cell phones in cars “no matter what,” and that in-car connectivity systems simply make the inevitable sin less dangerous. Of course, the evidence doesn’t seem to back up that position, as an IIHS survey shows no significant difference in safety after a hands-free cell phone ban. But, because the industry is under intense pressure to deliver profits from new connectivity systems, the logic that more systems will make drivers more likely to unsafely use phones in their cars is simply being ignored. And though the voluntary approach is better than intrusive government-mandated workarounds, is still nowhere close to living up to LaHood’s overblown rhetoric.

In October, Jefferson County, Missouri signed a contract with American Traffic Solutions (ATS) allowing the Arizona-based company to issue red light camera tickets in return for a cut of the profits. Now just three months later, the county council wants out of the deal. All seven members were unanimous in the desire to change direction, even signing a letter to lawmakers urging them to adopt a statewide ban on automated ticketing.

Residents in four cities in Washington state may opt for a ballot vote to ban the use of red light cameras and speed cameras. This week activists launched a coordinated effort to place the future of photo enforcement to a vote of the people in Bellingham, Longview, Monroe and Wenatchee. Each local group is following the battle plan established in Mukilteo where 71 percent of voters last year ousted automated enforcement.
